These Terms of Use govern your use of mottaone.com (the "Site"), operated by MottaOne LLC ("Motta One," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
These Terms cover the Site only. Any countertop, cabinetry, or remodeling work we perform is governed by a separate written proposal or contract signed by you and Motta One. If that contract conflicts with these Terms, the contract controls.
You may use the Site for personal, non-commercial purposes, such as researching our services and contacting us about a project. You agree not to:
Any prices, price ranges, or estimates shown on the Site or given through a website form, chat, or message are for general information only. They are not an offer or a binding quote. Your final price depends on an in-person consultation, accurate measurements or templating, material selection, site conditions, and the scope set out in your signed contract. Material availability and pricing can change without notice.
Granite, marble, quartzite, and other natural stones vary in color, veining, pattern, and texture from slab to slab. Photos, color catalog images, and screen colors may not exactly match the material installed in your home. Virtual reality walkthroughs, renderings, and design previews are illustrations to help you visualize a project and are not exact representations of the finished result. We encourage you to view and approve your actual slab in person before fabrication.
The Site and its content, including text, project photos, videos, virtual reality walkthroughs, logos, graphics, and design, are owned by Motta One or our licensors and protected by copyright, trademark, and other laws. "Motta One" and our logo are our trademarks. You may not copy, modify, distribute, or use them without our written permission, except to share a link to a Site page.
When you send us photos, plans, measurements, reviews, or other materials through the Site, email, text, WhatsApp, or social media, you confirm that you have the right to share them. You allow us to use them to respond to you and to quote, design, and complete your project. We will only use photos of your home or your name publicly, such as in our gallery or testimonials, with your permission.
Please do not send us confidential or sensitive information through the Site's forms or chat.
The Site may link to or include content from third parties, such as social media platforms, Google Maps and Reviews, YouTube, WhatsApp, and supplier or partner websites. We do not control and are not responsible for their content, products, or privacy practices. Your use of those services is subject to their own terms.
The Site and its content are provided "as is" and "as available." Design ideas, blog posts, material guides, and other information on the Site are for general inspiration and education. They are not professional engineering, structural, or construction advice for your specific home. To the fullest extent allowed by law, Motta One disclaims all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise the Site will always be available, error-free, or free of viruses.
Any warranty on our products or workmanship is provided only in your signed contract.
To the fullest extent allowed by law, Motta One and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site. Our total liability for any claim related to the Site will not exceed $100. This section does not limit our obligations under a signed project contract.
You agree to defend and hold harmless Motta One and its owners and employees from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute related to the Site will be brought in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Motta One about the Site.
We may update these Terms from time to time by posting a new version on this page and changing the effective date. Continuing to use the Site after changes are posted means you accept the updated Terms.
